GTC

These General Terms and Conditions (hereinafter GTC) of The AAA as a seller (throughout the site, the terms “we”, “us” and “our” refer to The AAA) and you as a customer apply to all orders on www.theaaa.ch as well as to those purchases in which The AAA declares these GTC applicable.

This website is owned and managed by Alaïa SA, with its registered office located at Route de Crans 81, 1978 Lens, Switzerland and VAT number CHE-374.281.299

Our store is hosted via Shopify Inc. They provide us with an online e-commerce platform that allows us to sell our products and services to you.

Scope of application

The GTC apply to all services provided by The AAA through the online shop www.theaaa.ch and become valid when a contract is concluded. The deliveries, services and offers of The AAA are made exclusively based on these GTC, even if they are not expressly agreed again. By submitting an order to The AAA, you confirm that you have read these GTC and expressly agree to them.

By agreeing to these Terms of Use, you declare that you are at least the age of majority in your state or province of residence, or that you are the age of majority in your state or province of residence and that you have given your consent to allow any of your minor dependents to use this website.

General Conditions

We reserve the right to refuse service to anyone for any reason at any time.

You understand that your content (excluding credit card information) may be transferred unencrypted and involves (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices. Credit card information is always encrypted during transfer over networks.

You agree to not reproduce, duplicate, copy, sell, resell, or exploit any portion of the Service, use of the Service, or access to the Service or any contact on the website through which the service is provided, without written permission. 

The headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms.

Conclusion of a contract

All information regarding goods and prices within the ordering process is subject to change and non-binding. Purchase contracts are concluded by the acceptance of your order by The AAA. The acceptance of the order will be confirmed by us via E-Mail and is subsequently binding for you. With your order, you confirm that you are aware of the scope and content of your order. Questions in this context can therefore be clarified with us in advance (hello@theaaa.ch). If The AAA subsequently recognizes that an error regarding the information of products, prices or availability has occurred, we will inform you immediately. You can confirm the order again under the changed conditions. Otherwise, we are entitled to withdraw from the contract.

Delivery

Ordered items will be delivered as soon as possible, depending on availability. If an item cannot be delivered immediately, The AAA will notify the buyer by E-Mail. Packages are generally shipped by local post or courier services. Our delivery time is usually 2 working days. However, this information is without guarantee. For deliveries abroad, additional taxes and duties may be collected by local custom authorities, which are generally to be borne by the customer. The delivery time depends on the location of the recipient.

Prices

Our prices are adapted to the market and are specified by the individual manufacturers as a recommended price, among others. All prices of The AAA on www.theaaa.ch include VAT required by law in Switzerland (currently 7,7%) and excluding shipping costs. Before completing the order, the effective shipping costs are displayed in the shopping cart. We can change the prices at any time. For the calculation of prices, the time of the order on the website applies.

Shipping costs

For each order, we charge a flat rate of 10 CHF. For order values above 100 CHF, your order is free of shipping costs within Switzerland. For the moment, we are only shipping in Switzerland.

Terms of payment

Currently, the following payment options are available to you:

Payment by credit card (Visa, Mastercard and Amex)

Retention of title / Set-off / Right of retention

(1) For consumers, we reserve ownership of the purchased item until the invoice amount has been fully paid. If you are an entrepreneur in the exercise of your commercial or independent professional activity, a legal entity under public law or a special fund under public law, we reserve ownership of the purchased item until all outstanding claims arising from the business relationship with the customer have been settled. The corresponding security rights are transferable to third parties.

(2) You are only entitled to offset if your counterclaims have been legally established or are undisputed or recognized by us. In addition, you only have a right of retention if and to the extent that your counterclaim is based on the same contractual relationship.

(3) If the customer is in arrears with us with any payment obligations, all existing claims become due immediately.

Right of withdrawal

Exchanges or returns are possible within 10 days of receipt. Exchange and/or return costs are to be borne by the customer. The goods must be returned in their original packaging and unused. Items that we have ordered from our suppliers especially for you are excluded from the right of return/exchange. The period of 10 days is granted if you declare the revocation in writing or by e-mail to support@theaaa.ch and after our approval return the goods to:

Transport damage must be reported to the post office within 5 days. Only after receipt of the goods returned in the described condition will The AAA reimburse you for the value of the goods.

Guarantee and warranty

The warranty for goods complies with generally accepted standards and is 12 months if a longer or shorter warranty period is not expressly stated on the delivered goods. Damaged goods must be reported in writing within 5 days of delivery or after the occurrence of the damage at the above address, otherwise the warranty claim expires. The warranty claim is valid from the date of delivery. It expires in case of improper use or natural wear. The AAA reserves the right to decide individually in the event of a warranty.

Minor model deviations

It can happen that the design of individual articles changes slightly. The AAA cannot naturally assume any liability for such modifications by manufacturers and suppliers. However, if you wish, you can exchange such items within 10 days, as listed above under the title Right of withdrawal.

Care/Handling

The AAA assumes no liability for the misconduct of the customer in the care and/or handling of the delivered items. We therefore ask you to observe the corresponding instructions on the goods.

Accuracy, completeness and timeliness of information

We are not responsible if information made available on this site is not accurate, complete or current. The material on this site is provided for general information only and should not be relied upon or used as the sole basis for making decisions without consulting primary, more accurate, more complete or more timely sources of information. Any reliance on the material on this site is at your own risk.

This site may contain certain historical information. Historical information, necessarily, is not current and is provided for your reference only. We reserve the right to modify the contents of this site at any time, but we have no obligation to update any information on our site. You agree that it is your responsibility to monitor changes to our site. 

Data protection

The AAA does not to pass on personal data to third parties. All personal data will be treated confidentially. The data necessary for business processing will be stored and, if necessary, passed on to affiliated companies as part of the order processing. However, no liability can be assumed for the security of the data transmitted on the Internet.

Optional Tools

We may provide you with access to third-party tools over which we do not have any control. You acknowledge and agree that we provide access to such tools "as is" and "as available" without any warranties, representations or conditions of any kind and without any endorsement. We assume no liability arising from or related to your use of optional third-party tools.

Any use by you of optional tools offered through the site is entirely at your own risk and discretion and you should ensure that you are familiar with and approve of the terms on which the tools are provided by the third party provider(s) concerned.

We may also, in the future, offer new services and/or features through the Website (including the release of new tools and resources). These new features and/or services will also be subject to these Terms of Use.

Certain content, products and services available through our Service may include materials from third parties.

Third-party links on this site may direct you to third-party websites that are not affiliated with us. We are not responsible for examining or evaluating the content or accuracy and we do not warrant and shall have no liability for any third-party materials or websites, or for any other materials, products or services of third.

We are not responsible for any damages or harm related to the purchase or use of goods, services, resources, content, or any other transactions made in connection with third-party websites. Please read the third party's policies and practices carefully and make sure you understand them before engaging in any transaction. Complaints, claims, concerns or questions regarding Third Party Products should be directed to the Third Party.

Liability

It should be expressly pointed out that no liability claims can be asserted against The AAA for indirect or consequential damage to the customer, unless there are intentional or grossly negligent damage caused by The AAA. In particular, damage from accidents, etc. resulting from the handling of hardware (surfboards, etc.) is your own responsibility.

Changes to the GTC

We expressly reserve the right to unilaterally change the present GTC at any time without prior notice. The terms and conditions as published in the web shop apply.

Choice of law

In any case, the relationships between you and The AAA are subject to Swiss law in accordance with the provisions of the Swiss Code of Obligations (OR) and the Swiss Civil Code (ZGB). The application of the provisions of the Vienna Convention on Contracts for the International Sale of Goods ("United Nations Convention on Contracts for the International Sale of Goods") is expressly excluded.

The place of jurisdiction is the legal seat of The AAA, currently in Valais, unless the place of jurisdiction is governed by the Jurisdiction Act. However, The AAA reserves the right to prosecute the customer in the courts of his domicile or at any other competent court.
